Pre-requisites for Registration
To successfully register a design in India, there are certain essential requirements that must be met. First and foremost, the design must be new and original, meaning it should not have been published, used, or disclosed anywhere in India or internationally before the filing date. It must be applied to a physical article, such as packaging, furniture, machines, or fashion items—designs cannot exist independently of a tangible product. Additionally, the design should have visual appeal, meaning it must be capable of being judged solely by the eye; purely functional or technical features are not eligible for registration. The design must not be obscene, offensive, or contrary to public order or morality. Lastly, it should be distinctive and clearly different from any existing design in the public domain. Fulfilling these criteria ensures your design stands a strong chance of being granted legal protection.

- Representation Sheets (drawings, sketches, or images of the design – 6 views: front, back, top, bottom, left, right)
- Form 1 – Application for registration of design
- Statement of Novelty – Explaining what makes your design unique
- Power of Attorney – If filed through a patent/design agent
- Certified Copy of Priority Document (if claiming priority from a foreign application)
- Name and Address of the Applicant
- Details of the Article – To which the design is applied
- Class and Subclass of the Design (as per Locarno Classification)
